The FitTransformer App Privacy Policy (hereinafter referred to as the “Policy”) applies only to the FitTransformer App products or services provided by Thousandshores Inc. (Address:37707 Cherry Street, Newark California 94560, United States, hereinafter referred as "the company" or "us"). This Policy describes how we collect, store, use, disclose, and otherwise process your personal information when providing you with the FitTransformer App services, as well as the rights and choices you have regarding such information.

1. Collection and Use of User Information
We will only collect and use your user information within the scope described in this Policy. The purpose of collecting this information is to provide you with products or services. You have the right to decide whether to provide the relevant information, but please note that in most cases, if you choose not to provide the necessary information, we may be unable to provide you with the corresponding services or respond to the issues you encounter.
When you use our services, we may collect information that you actively provide or that is necessary for providing the service, including:
1.1. Information You Provide Actively
Certain services may require you to provide specific personal sensitive information to achieve specific functionalities. If you choose not to provide such information, it may affect your ability to use related functions, but will not affect your use of other service features. By voluntarily providing personal sensitive information, you consent to our processing of your information as described in this Policy.
a. Information Provided During Registration: For example, the nickname, email address, height, weight, and other information you fill out when registering an account.
b. Information Provided When Using Services: For example, the avatar you upload, photos you share, and other content.
c. Information Provided Through Customer Service or Participation in Activities: For example, personal information such as your name, phone number, home address, etc., provided in surveys when you participate in our online activities.
1.2. Information We Collect
a. Log Information:
When you use our services, we may automatically collect and store some relevant information as service logs, including:
Device Information: For example, device model, operating system version, unique device identifier, battery information, signal strength, etc.
Software Information: To ensure the security of the operating environment and provide necessary services, we collect information about the mobile applications and other software you use, such as the software version number, browser type, etc.
IP Address: We record your IP address to identify your device and optimize services.
Service Log Information: This includes your search records, browsing information, service failure records, referral URLs, etc., when using the service.
b. Location Information
When you use our services, we may collect your geographic location information through IP address, GPS, Wi-Fi, or base stations. This information may come from content provided by you or other users when using the service, such as:
Account Information: The account information you provide may include your region or location information.
Geotags in Photos: Photos shared by you or other users may contain geographic location information.
When you use location-based services, you can choose to enable your device's location feature. We will record your device’s location information to provide more accurate services. You can also stop us from collecting your location information by disabling the location feature at any time.
c. Exercise Data
When you connect your exercise device with our app, the generated exercise data will be recorded and collected. This data includes information such as your exercise volume, duration, and other related metrics.
1.3. Exceptions to Obtaining Consent
Please understand that under relevant laws, regulations, and national standards, we are not required to obtain your authorization for the collection and use of your user information in the following situations:
a. Directly related to national security or national defense security;
b. Directly related to public safety, public health, or major public interests;
c. Directly related to criminal investigations, prosecutions, trials, or enforcement of judgments;
d. To protect the life, property, or other major legitimate rights and interests of you or other individuals when it is difficult to obtain your consent;
e. Your user information that has been publicly disclosed by you;
f. User information collected from legally disclosed sources, such as legitimate news reports or government information publicized;
g. Necessary for signing or performing contracts as requested by you;
h. Necessary to maintain the security and stable operation of software and related services, such as discovering and handling software and service faults;
i. Other situations prescribed by laws and regulations.
1.4. Use of Information
The information described above that you provide will continue to be authorized for our use during your use of the Service. We will collect and use your personal information for the purposes described in this Policy, within a lawful, legitimate, necessary, and clearly defined scope.
If you are located in the European Economic Area (EEA), the legal bases for our processing of your personal information include: processing necessary for the performance of a service agreement with you; processing based on your consent; processing necessary for compliance with applicable legal obligations; and processing based on our legitimate interests, including providing, maintaining, and improving the Service, ensuring account and system security, preventing fraud and abuse, responding to your requests, and maintaining our service relationship with you. These legal bases include Article 6(1)(a), (b), (c), and (f) of the GDPR. If you are located in the United Kingdom, we will process your personal information in accordance with the UK GDPR and other applicable data protection laws where applicable.
If you are located in the United States, we will process your personal information in accordance with applicable U.S. federal and state privacy, consumer protection, and data security laws, including but not limited to applicable state privacy laws, consumer privacy protection rules, and rules relating to unfair or deceptive business practices. To the extent required by applicable law, you may have the right to know about, access, correct, and delete your personal information, to limit the use of sensitive personal information, and to opt out of the sale or sharing of personal information or targeted advertising. We currently do not sell your personal information and do not use your personal information for targeted advertising as defined under applicable privacy laws. If this changes in the future, we will notify you in advance as required by law and provide you with appropriate choices.
We collect and use your personal information mainly for the following purposes:
Providing products and services: We use your personal information to provide the FitTransformer software services, including account registration and login, identity verification, device binding, exercise data recording, avatar or image display, basic function operation, and service status maintenance, so that you can properly use our products and services.
Processing exercise and device-related data: After you connect a fitness device with the App, we will collect and process data related to the exercise services, such as exercise volume, exercise duration, and device connection status. This information is used to display your exercise records, provide basic data analysis, and improve the product experience. Where sensitive information or health-related information is involved, we will obtain your consent or process such information by other legally permitted means to the extent required by applicable law.
Security and fraud prevention: We use your personal information to detect, investigate, or handle possible fraud, illegal or malicious activities, abnormal login attempts, system failures, or security incidents, in order to protect your account security, product security, and the legitimate rights and interests of other users. If you register for and use our services, you are also responsible for properly safeguarding your account information. Please do not share your username, password, or other access credentials with others. If you believe that your account may have been compromised, please contact us immediately.
Communication with you and service improvement: We use your personal information to provide customer support, handle your inquiries, complaints, feedback, or requests, and improve our products, functions, service quality, and user experience based on your use of the Service.
Compliance with legal obligations and dispute resolution: Where necessary under laws and regulations, regulatory requirements, judicial or administrative authority requirements, or for the protection of our, your, and other users’ legitimate rights and interests, we may use your personal information for compliance review, dispute resolution, rights protection, security audits, or cooperation with regulatory investigations.
If we use your personal information for purposes not stated in this Policy, or use information collected for a specific purpose for other purposes, we will inform you before such processing and obtain your consent where required by applicable law.
2. Cookies and Similar Technologies
2.1. Cookies
To ensure the proper functioning of the software, we store small data files called cookies on your device. Cookies typically contain an identifier, site name, and some numbers and characters. Through cookies, you can conveniently access the user agreements and privacy policies we provide on the web. We commit not to use cookies for purposes outside the scope of this agreement. You can manage or delete cookies according to your personal preferences, such as clearing the app cache to remove these files.
2.2. SDKs
SDKs (Software Development Kits) help developers integrate specific features or services into applications. We use SDKs to enhance the user experience and application functionality. Please refer to the following links to understand how these SDKs handle your data:

3. Sharing, Transfer, and Disclosure of Information
3.1. Sharing
We do not share your user information with other companies, organizations, or individuals, except in the following cases:
With Your Explicit Consent: We may share your user information with third parties if we have obtained your explicit consent. For example, if you choose to use third-party services that cooperate with FitTransformer, and we need to provide your user information to that third party for you to use their service, we will assume that you agree to share your information with that third party, such as sharing your exercise data.
Legal Requirements or Government Authority Requests: We may share your user information in accordance with applicable laws and regulations, or when required by government authorities.
Sharing with Affiliate Companies: Your user information may be shared with our affiliate companies. We will only share necessary information, and the use of this information will be subject to the purposes stated in this Privacy Policy. If an affiliate company changes the purpose for processing your information, we will seek your authorization again.
Sharing with Authorized Partners: Some of our services are provided by authorized partners to achieve the purposes outlined in the agreement. We may share your user information with partners to offer better customer service and user experience. We will only share your information for legitimate, necessary, specific, and explicit purposes, and only the information necessary to provide the service will be shared. You agree that we may share the information collected with authorized partners for other services and uses, in compliance with relevant laws and regulations.
For companies, organizations, and individuals with whom we share user information, we will require them to process the information in accordance with our instructions, this Privacy Policy, and other relevant confidentiality and security measures.
3.2. Transfer
We do not transfer your user information to any company, organization, or individual, except in the following cases:
a. With Your Explicit Consent: We will transfer your information with your explicit consent.
b. In Case of Merger, Acquisition, or Bankruptcy Liquidation: During a merger, acquisition, or bankruptcy liquidation, if the transfer of user information is involved, we will require the new holder of your user information to comply with the constraints of this Privacy Policy. Otherwise, we will ask the new company or organization to seek your consent again.
3.3. Disclosure
We will only publicly disclose your user information in the following cases:
a. With Your Explicit Consent: We will disclose your information if we have obtained your explicit consent.
b. Legal, Legal Process, Litigation, or Government Authority Request: We may disclose your user information in compliance with laws, legal processes, litigation, or as required by government authorities.
3.4. Exceptions for Obtaining Authorization Consent
Please understand that, according to relevant laws, regulations, and national standards, we may share, transfer, or publicly disclose your user information without obtaining your consent in the following circumstances:
a. Related to National Security or National Defense.
b. Related to Public Safety, Public Health, or Major Public Interests.
c. Directly Related to Criminal Investigation, Prosecution, Trial, and Enforcement of Judgment.
d. To Protect Major Legal Rights of You or Other Individuals, but Difficult to Obtain Consent.
e. Information You Have Made Public.
f. User Information Collected from Legally Disclosed Sources, such as legal news reports, government disclosures, etc.
4. Protection of User Information
We have implemented security measures in line with industry standards to protect the user information you provide, preventing unauthorized access, disclosure, use, modification, destruction, or loss of data. We are committed to taking all reasonable and feasible measures to ensure the security of your information. For example, we use encryption technologies to ensure the confidentiality of data; we employ trusted protection mechanisms to prevent malicious attacks; we implement access control mechanisms to ensure that only authorized personnel can access user information; and we conduct security and privacy protection training to raise employee awareness of the importance of protecting user information.
We also strive to ensure that we only collect user information related to the purposes of this policy and that we retain your user information only for the duration necessary to achieve the purposes described in this policy, unless required by law or if an extended retention period is needed.
However, please understand that the internet environment is not 100% secure. While we make every effort and take all reasonable and necessary measures to protect your user information, we cannot rule out the risk that information may be subject to unauthorized access, theft, tampering, or destruction during transmission or storage, which may lead to damage to your legal rights. Please understand and voluntarily bear the risks related to online information security.
In the unfortunate event of a user information security incident, we will notify you of the relevant situation in a timely manner, as required by law and regulations. Additionally, we will proactively report the handling of the user information security incident to regulatory authorities as required.
5. Your Rights
5.1. Access to Your User Information
You have the right to access your user information through the App. If you are unable to access certain information through the App, you may request access by emailing us at feedback@FitTransformer.com.
5.2. Correcting Your User Information
If you find that any information we have about you is incorrect, you have the right to correct it through the App. If you are unable to correct it yourself, you can request correction by sending an email to feedback@FitTransformer.com.
5.3. Deleting Your User Information
You have the right to request the deletion of your user information in the following circumstances:
a. If we process your information in violation of laws or regulations.
b. If we collect or use your information without your consent.
c. If we violate the terms agreed upon for processing your information.
d. If you no longer use our products or services, or if you cancel your account.
e. If we no longer provide products or services to you.
We will evaluate your deletion request and take the appropriate steps. If necessary, you may be asked to authenticate your identity to ensure account security. Please note that after you delete your information, due to applicable laws and technical requirements, the information may not be immediately deleted from backup systems, but we will remove or anonymize the relevant information as soon as possible.
5.4. Right to Opt-Out of the Sale, Sharing, or Targeted Advertising
You have the right to request that we do not "sell" or "share" your personal information, or opt out of the processing of your personal information for purposes defined by privacy laws as "targeted advertising." Currently, we do not "sell" your information or engage in "targeted advertising." If such activities arise in the future, we will notify you in advance and obtain your consent.
5.5. Changing the Scope of Authorization Consent
You can update or withdraw your consent to the collection and use of your personal information at any time. Withdrawing your consent will not affect the legality of personal information processing activities based on your consent prior to withdrawal. You can unbind this through your account settings in the App. If you withdraw your consent, you may not be able to continue using all or part of the App's services. After you withdraw consent, we will stop processing your personal information.
5.6. Account Deletion
You may choose to delete your account at any time. Once your account is deleted, we will stop providing products or services to you, and we will delete or anonymize your information according to your request (unless otherwise required by law or regulations). Please note that unless you re-register your account, you will not be able to continue using the services provided by the App. We recommend that you carefully consider your decision before deleting your account.
5.7. Responding to Your Requests
To ensure security, we may ask you to submit a written request or verify your identity in another way before processing your request. We will respond within thirty days.
For reasonable requests, we generally do not charge any fees. However, for repeated or excessive requests, we may charge a reasonable processing fee. Please understand that due to security concerns, legal requirements, or technical limitations, we may not be able to respond to certain requests, including but not limited to the following situations:
a. Related to the fulfillment of legal obligations by the data controller.
b. Directly related to national security or defense security.
c. Directly related to public safety, public health, or significant public interest.
d. Directly related to criminal investigations, prosecutions, trials, or the execution of judgments.
e. If there is sufficient evidence showing that the data subject has malicious intent or abuses their rights.
f. To protect the life, property, or other significant legal interests of the data subject or others, when it is difficult to obtain consent.
g. If responding to the request would severely damage the legal rights of the data subject or other individuals or organizations.
h. Involving commercial secrets.
6. Protection of Children's Personal Information
We place great importance on the protection of children's personal information. Our products, websites, and services are not intended for children, and we do not knowingly collect information directly from children. Children should not create their own user accounts without the consent of a parent or guardian. While the definition of a child may vary based on local laws and customs, we consider anyone under the age of 13 to be a child.
For children's user information collected with the consent of a parent or guardian, we will only store, use, or disclose such information as permitted by law, with the explicit consent of the parent or guardian, or when necessary to protect the child. Given current technical and business limitations, we may not be able to proactively identify personal information from children. If you find that we have collected personal information from a child without verifiable parental consent, please contact us immediately, and we will delete the relevant data as soon as we confirm the issue.
7. Storage and Transfer of Information
7.1. Information Storage Location
In general, user data will be stored on Alibaba Cloud servers located in the United States. For the App downloaded from the Apple App Store in mainland China, the user data we collect will be stored on Alibaba Cloud servers located in China. Additionally, we may process this data in other regions where our affiliated companies and service providers are located.
7.2. Data Retention Period
We will retain your user information only for the period necessary to fulfill the purposes described in this policy, and for the shortest period required by law or regulations. Once this retention period expires, we will delete or anonymize your information in accordance with applicable laws and regulations, unless otherwise required by law or you provide separate consent.
When our products or services cease operations, we will notify you through push notifications or announcements and delete your personal information within a reasonable period.
7.3. Global Transfer of Information
Your user information may be transferred to jurisdictions outside the country or region where you use our products or services, or may be accessed by these jurisdictions. We will seek your consent or, before transferring data across borders, implement security measures such as data anonymization to ensure the safety of your information.
8. How This Policy is Updated
Our privacy policy may change. We will not reduce the rights you are entitled to under this policy without your explicit consent. Any changes to this policy will be posted on this page, and we recommend that you regularly review this page for updates. For significant changes, we will also provide more prominent notifications. Significant changes include but are not limited to:
a. A significant change in our service model, such as changes in the purposes, types, or ways of processing user information;
b. A significant change in our ownership structure or organizational structure, such as changes due to business adjustments, mergers, or acquisitions;
c. A significant change in the main parties to whom user information is shared, transferred, or publicly disclosed;
d. A significant change in the rights and methods by which you participate in the processing of your user information;
e. A high-risk user information security impact assessment report.
